Govt directs e-commerce platforms to remove Bournvita, other similar beverages from 'health drink' category

E-commerce businesses have received advice from the Ministry of Commerce and Industry directing them to remove all drinks, including Bournvita, from the "health drinks" category on their platforms and portals. "After concluding that there is no "health drink," the National Commission for Protection of Child Rights (NCPCR), a statutory body established under Section (3) of the Commission of Protection of Child Rights (CPCR) Act, 2005, conducted an inquiry under Section 14 of the CRPC Act of 2005. The Food Safety and Standards Authority of India (FSSAI) was contacted earlier that they were marketing power supplements as "health drinks" despite not adhering to safety regulations. The regulatory agency claims that the term "health drink" is not defined in the nation's food laws and that it is against the law to present anything as such. The FSSAI also instructed e-commerce sites earlier this month to refrain from labeling dairy- or malt-based beverages as "health drinks." The health drinks Bournvita, which is owned by Mondelez India, was instructed to remove all "misleading" labels, packaging, and ads by Apex Child Rights Body NCPCR last year after a video suggested that the beverage contains a lot of sugar.
